Terms & Conditions

These terms and conditions ("Conditions") govern your use of our online website, relationship with Dine for Fun ("Dine for Fun"/ "we"/ "us") and your participation in the Dine for Fun activities and competition(s). Our providing the opportunity to take part in the Dine for Fun activities and/or competition(s) is referred to in these Conditions as the "Services". Please read the Conditions carefully as they affect your rights and liabilities under the law. By clicking "I accept" at the end of this screen and continuing to access the website at www.dineforfun.com (the "Website"), you are forming a contract and agreeing to the Conditions that appear below. If you do not agree to these Conditions, you are not permitted to use the Website and you may not register your details on it or request Membership of Dine for Fun. If you have any queries on the Conditions, please contact enquiries@dineforfun.com.

1        Use of the Website and Provision of Services

1.1         The Website is provided to you for your personal use subject to these Conditions. By using the Website you agree to be bound by these Conditions.

1.2         This Website is only intended for use by people resident in the United Kingdom.  We regret that we cannot currently offer the Services to people living elsewhere.

1.3         We shall use reasonable endeavours to provide the Services in accordance in all material respects with these Conditions.

1.4         This Website and the Services are provided by Robert Broadfoot, trading as Dine for Fun, whose correspondence address is at PO Box 9070, Great King Street, Dumfries and VAT number is 842 9351 16. You will be eligible to receive the Services following our acceptance of your registration, and our confirmation of your membership ("Membership") when you have applied to take part.

1.5         We are continually seeking to improve the Services. We reserve the right, at our discretion, to make changes to any part of the Services provided that they do not materially reduce the quality, content or functionality.

1.6         Although we aim to offer you the best service possible, we make no promise that the Services shall meet your requirements. We cannot guarantee that the Website or the Services will be fault-free. If a fault occurs with the Website, you should report it via the link at http://www.dineforfun.com/contact-us and we will attempt to correct the fault as soon as we reasonably can.

1.7         Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the Services as soon as we reasonably can.

1.8         Following your acceptance of these Conditions and application for Membership we may accept your application for Membership. By registering your details on our Website you are making an offer to become a Member of Dine for Fun.

1.9         Becoming a Member does not in itself give you a right or an obligation to take part in Dine for Fun.

1.10       A contract between you and us is formed only when we have confirmed your Membership and you have paid the Party Fee, whereupon we will endeavour to provide the Services to you and except as set out in these Conditions you will have no right to cancel the contract before the end of your Membership once we have done so.

2        Dine for Fun

2.1         Our Website allows you to register your details and your profile and, if you want to take part in Dine for Fun, apply to become a member ("Member") of the Dine for Fun network.

2.2         Dine for Fun is a networking site which brings together individuals with the aim of competing with each other to host the best dinner party ("Dinner Party") amongst a group of other Members (known as a "Dine for Fun Group").

3        Registration on this Website

3.1         To register on the Website you must be over eighteen years of age, and resident in the United Kingdom.

3.2         By registering your details, you warrant that:

3.2.1       You are legally capable of entering into binding contracts;

3.2.2       You are at least 18 years old;

3.2.3       You are resident in the United Kingdom; and

3.2.4       You are accessing this Website from the United Kingdom.

3.3         Each registration is for a single user only. On registration, you will be asked to create a password. You will be able to apply to access the Services, following registration, using your email address and password ("ID"). In order to prevent fraud, you are responsible for all use of the Website using your ID and for preventing unauthorised use of your ID.

3.4         If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID, you must notify us immediately via the link at http://www.dineforfun.com/contact-us. If we reasonably believe that your ID is being used in any way which may lead to a breach of security or misuse of the Website, we reserve the right to require you to change your ID or suspend your access rights immediately on giving notice to you and to block access from your ID until the issue has been resolved.

3.5         You shall be asked to provide the following compulsory personal information when you apply to register with Dine for Fun (this information comprises your "Account"):-

3.5.1        your name;

3.5.2        address;

3.5.3        telephone number

3.5.4        date of birth; and

3.5.5        e-mail address;

We require your email address and telephone number in order to administer your account and, if you want to take part in Dine for Fun, to arrange Dinner Parties, but we shall not share your email address and telephone number with any other person.   

3.6         You will also have the opportunity to add some information to let other Members know a little bit about you if you decide to take part in Dine for Fun and become a Member (this known as your "Profile"), including:

3.6.1       A photograph of you;

3.6.2       Your sexuality;

3.6.3       Your interests and likes;

3.6.4       Your drinking habits;

3.6.5       Your dietary requirements, allergies, food intolerances (important – see Condition 3.7 below); and

3.6.6       Any other (appropriate) information you want to add;

Subject to Condition 3.7 below, this information is voluntary and does not have to be submitted, but it will be visible to other Members of your Dine for Fun Group if you chose to participate and become a Member.

3.7         IMPORTANT: - It is your responsibility to ensure that you let us know about your dietary requirements and/or allergies and keep this information up to date. 

3.8         You must ensure that the details provided by you on registration or at any time are correct and complete. It is your responsibility to update us of any changes to your details (including your email address):

3.8.1       You can update your Account by clicking on the Your Account link on the Website; and

3.8.2       You can edit or update your Profile by clicking on the Edit Your Profile link on the Website.

3.9         Errors in your registration must be corrected by as soon as you become aware of them. You can correct errors as follows:-

3.9.1       before you submit your registration form: by deleting the inaccurate details and re-entering the relevant information on the registration form; or

3.9.2       after you submit your registration form: by using the Your Account or Edit Your Profile links as detailed in Condition 3.8 above.

3.10       We will send you an email within 3 days of receipt of receipt of your online registration either confirming registration of your Dine for Fun Account or letting you know that we are unable to offer you the chance to register.

3.11       We reserve the right to refuse any registration at our sole discretion.

4         Taking Part in Dine for Fun/ Formation of Contract

4.1         If you want to take part in Dine for Fun, you must first register your details and open a Dine for Fun Account.  You must make sure you have read the section below entitled Members' Obligations, and then you can apply to take part in the Dine for Fun competition by clicking on the "Arrange me a Party!" link and making payment (see Fees and Payment below).

4.2         When you click on "Arrange me a Party!" you will be asked to provide details on how many people you would ideally like to be in your Dine for Fun Group, how far you are willing to travel, and what days of the week you expect to be able to attend.

4.3         There will be no contract of any kind between you and us until we have accepted in writing your request to become a Member.  We will send you an email within 7 days of receipt of your request either confirming your Membership ("Membership Confirmation") or letting you know that we are unable to offer you the chance to participate.  Please note this is different from the email confirming our receipt of your payment, which you will always receive within 48 hours of making payment to us (see Condition 5.2).

4.4         We shall be under no obligation to provide Membership.  If we are unable (in our absolute discretion) to provide Membership, we will inform you by email within 7 days of you applying to participate and refund any payment of our fees to you within 3 days  of informing you of our decision.

4.5         Dine for Fun relies on Members fulfilling their obligations under these Conditions. Your participation relies on that, and on there being enough Members in your area who wish to participate.  We cannot always promise, when you do become a Member that we will be able to arrange Dinner Parties for you, but if we are unable to do so through no fault of yours, we will refund your Party Fee (see the section entitled Fees and Payment below).

5        Fees and Payment

5.1         The fee to join in a Dine for Fun Group ("Party Fee") will be based on the number of Dinner Parties you can expect to attend in your Dine for Fun Group (£5 for each such party). 

5.2         When you indicate how many people you would like to have in your Dine for Fun Group, our system will calculate the likely Party Fee as follows:

Number of people you have indicated minus one (yourself) x £5.

This amount is payable in advance as set out on the Website by credit or debit card or by such method of payment as we reasonably request. All payments are processed by an independent third party, PayPal.

5.3         If you later agree to participate in a Dine for Fun Group with more Members than your preference, you will have to pay any additional part of the Party Fee (calculated in accordance with Condition 5.2).

5.4         We may allocate you to a Dine for Fun Group with fewer Members than you requested, in which case we will refund the difference between the amount you have actually paid and the properly due Party Fee (calculated in accordance with Condition 5.2).

5.5         When we have received authorised payment we will send you an email acknowledging receipt within 48 hours. This is not confirmation of your Membership and no contract is formed at this point (see Condition 4.3).

5.6         Following your application to participate in Dine for Fun, we shall endeavour to allocate you to a Dine for Fun Group comprised of:-

5.6.1       the number of Members that you have indicated a preference for;

5.6.2       who are all located within the distance from your home that you have indicated a preference for.

It may take up to four weeks to set up a Dine for Fun Group. We shall advise you by email when we have allocated you to your Dine for Fun Group (and, for the avoidance of doubt, your right to cancel the contract with us will cease).

5.7         We regret that for a various reasons we may be unable to arrange a Dine for Fun Group for some applicants (for example, there may not be enough other Members or people who wish to become Members in your area). In the event that we are unable to allocate you to a Dine for Fun Group within 30 days of your request to participate, we shall contact you, and where possible, offer to allocate you to an alternative group (which may be larger than the group-size which you requested, or whose members may live at a greater distance from your home). If we are unable to offer an alternative, or you do not accept the alternative offered, you will receive a full refund of your Party Fee within 3 days of advising us that our advising you that we cannot allocate you to a nearby group.

5.8         Where we offer an alternative, you must

5.8.1       contact us within 14 days to advise us that the alternative is acceptable to you, and

5.8.2       pay any additional amount necessary to constitute the Party Fee if you have been allocated to a larger Dine for Fun Group)

otherwise our offer to allocate you to that alternative group will be deemed to be withdrawn and your Membership will be deemed to have expired. We will send you an email to confirm this and you will be refunded within 3 days.

5.9         If you win a Dine for Fun Group and are invited to participate in a further round of Dine for Fun, you are under no obligation to do so. If you do wish to take part in a further round, you will need to follow the instructions on the Website or as emailed or otherwise communicated to you by us and pay the appropriate Party Fee.

5.10       Your Membership will renew only if you make payment of the Party Fee before applying to join a new Dine for Fun Group (including, where appropriate, groups comprised of the winners of other Dine for Fun Groups). If you fail to pay the Party Fee for any subsequent Dine for Fun Group at the point of application then we may suspend your access to the Services until your Party Fee is paid.

6        Dinner Parties

6.1         You will be asked when we confirm that you have been allocated to a Dine for Fun Group to provide information as to dates on which you are available to be a guest or host of a Dinner Party and we will endeavour to arrange the dates of Dinner Parties to fit in with your availability and those of the other Members of your Dine for Fun Group. If you fail to provide information on your availability within one week of receiving our email , then you will be deemed to have withdrawn from Dine for Fun. We regret that in this circumstance, no refund will be given.

6.2         Once you have been allocated a Dine for Fun Group, you will then be contacted with details of the other group Members, as posted by the Members on their profiles.

6.3         Each member of the group shall on one occasion host a dinner party for the other group members. We shall endeavour to arrange the order in which Members shall each be a host, and shall inform you as soon as possible of the dates on which you are expected to either attend or host a Dinner Party. We shall contact all Members of the Dine for Fun Group with the date of the first Dinner Party, and the name of the Member who shall be hosting on that date.

6.4         Dinner parties will then be held weekly on the same day of each week – if the first party is hosted on a Friday, the next host shall give a Dinner Party on the following Friday, and so on, until all the Members of that group have hosted on one occasion.

6.5         If you fail, without contacting us (or where appropriate, your host for that particular Dinner Party) to hold a Dinner Party on the dates set by us (or on a date fixed by agreement between all the Members of your Dine for Fun Group), you will be deemed to have withdrawn from Dine for Fun.   We regret that in such circumstances, no refund will be given.

6.6         In the event that a Member of a Dine for Fun Group either withdraws from taking part, or we withdraw their registration as a Member, we reserve the right to substitute another Member into that Dine for Fun Group. The substitute Member shall be given the opportunity to host a Dinner Party for that Dine for Fun Group.

6.7         Following each Dinner Party, the guests must post a rating from 1 to 10 for that Dinner Party via an email reply to an invitation to score that we shall send you immediately after the Dinner Party in question. You will also be able (if you like) to add your comments about the Dinner Party. Guests must keep their scores a secret until the winner of their Dine for Fun Group is announced. The score and comments will together comprise a Member’s "Review" and are subject to the conditions stated below at Condition 7.3.

6.8         Members must not share, agree, or in any way attempt to distort the scores pertaining to another Member.

6.9         If a member of a Dine for Fun Group either:-

6.9.1       is unable to attend a Dinner Party; or

6.9.2       attends a Dinner Party but does not post a rating within the specified time;

then he or she will be deemed to have given the Dinner Party in question a rating which is equal to the average of the ratings given by the guests who did attend and post a rating.

6.10       When all the members of the Dine for Fun Group have hosted a Dinner Party, the ratings for each Dinner Party will be aggregated, and the Member who hosted the Dinner Party with the highest aggregate rating shall be the winner of that Dine for Fun Group.

6.11       The winner in each Dine for Fun Group shall be able to enter into further competition with winners from other groups (subject to payment of the Party Fee), with the winners then being entitled to enter into further competition. Dine for Fun Groups in these later stages of competition may consist of less than six Members.  The Member who wins the final Dine for Fun Group will be the overall winner.

7        Your use of the Website

7.1         Restrictions on what you may do.

You may not use the Website for any of the following purposes:

7.1.1       disseminating any unlawful, harassing, defamatory, abusive, threatening, harmful or otherwise objectionable material or otherwise breaching any laws;

7.1.2       transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable legislation, regulations or code of practice;

7.1.3       interfering with any other person’s use or enjoyment of the Website;

7.1.4       making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

7.2         Uploading material

7.2.1       Your obligations:

If you upload any material onto our Website:        you warrant that you are the owner of that material or otherwise have the right to upload, transmit and store it;        you warrant that the material is not, defamatory, abusive, threatening, harassing, harmful or otherwise unlawful or objectionable;        you grant us a non-exclusive, perpetual, royalty-free licence to store, publish and/or  transmit the material on our Website;        you must comply with Condition 7.1 above; and        you agree to indemnify us against any losses and costs incurred by us resulting from your breach of this clause 7 (this means you will be responsible for these losses and costs).

7.2.2       Our rights and liabilities

If you upload any material onto our Website:        we shall have the right to use, copy, distribute and disclose to third parties any such material for any purpose;        we have the right to disclose your identity to any third party who is claiming that any third party who is claiming that any material posted or uploaded by you to our Website constitutes a violation of their intellectual property rights;        we will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Website; and        we have the right to remove any material or posting you make on our Website if, in our opinion, such material does not comply with acceptable content standards.

7.3         Comments and Scoring

7.3.1       Following each Dinner Party you attend as a guest, you will be sent an email by Dine for Fun. You will be asked to send your score for the Dinner Party and any comments you wish to make (which together form a Member’s Review) by replying to such email.

7.3.2       Any comments you make in your Review will be posted on the Website and visible to the other Members in your Dine for Fun Group. You are under no obligation to make any comments but if you do then you must ensure that they comply with the Content Standards (see Condition 7.3.1 of these Conditions)

7.3.3       The comments in Reviews are note moderated, nor do we actively monitor the content of the Reviews submitted.  We act as a mere conduit in providing the means by which comments are exchanged.  We will not be responsible as author, editor or publisher of any comments or any Review submitted by a Member and we expressly exclude our liability for any loss or damage by any person in contravention of the Content Standards or these Conditions.  We reserve the right to promptly remove, or to disable access to, any Review or comments which we deem to be potentially defamatory of any person, unlawful, in violation of any third party rights, or otherwise contrary to the Content Standards or these Conditions.

7.4         Content Standards

7.4.1       These content standards "Content Standards" apply to each part of a Review as well as to its whole. The Content Standards must be complied with in spirit as well as to the letter. We will determine, in our discretion, whether a Review breaches the Content Standards.

7.4.2       A Review must:        be accurate (where it states facts);        be genuinely held (where it states opinions);        comply with the applicable law in the UK and any country from which it is posted;        be relevant.

7.4.3       A Review must not:        be defamatory of any person;        be obscene, offensive, hateful or inflammatory;        promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;        disclose the name, address, telephone, mobile or fax number, e-mail address or any other personal data in respect of any individual;        infringe any copyright, database right or trade mark of any other person;        breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;        be in contempt of court;        be likely to harass, upset, embarrass, alarm or annoy any other person; or        impersonate any person, or misrepresent your identity or affiliation with any person; or       give the impression that the Review emanates from any other person if this is not the case; or       advocate, promote, incite any third party to commit, or assist any unlawful or criminal act; or       contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism; or       contain any advertising or promote any services or web links to other sites; or

7.4.4       By submitting a Review, you agree to grant us a non-exclusive licence to use that Review. Although you still own the copyright in your Review, we will have the right to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your Review. This licence will be free of charge, perpetual and capable of sub-licence. We may exercise all copyright and publicity rights in the material contained in your Review in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.

7.4.5       Please also note that, in accordance with the Content Standards, you must ensure that your Review does not infringe any copyright, database right or trade mark of any other person.  By submitting your Review, you are warranting that you have the right to grant us the non-exclusive copyright licence described above.

7.4.6       If you wish to complain about any Review published on the Website, please contact us via the link at http://www.dineforfun.com/contact-us.  We will then review the Review and decide whether it complies with our Content Standards. We will remove any Review which, in our opinion, does not comply with our Content Standards. We will inform you of the outcome of our review within a reasonable time of receiving your complaint.

7.4.7       Breach of these Content Standards

                   When we consider that a breach of the Content Standards has occurred, we may at our discretion take such action as we deem appropriate.  Failure to comply with these Content Standards constitutes a material breach of the Conditions of use on which you are permitted to use our Website and take part in Dine for Fun, and may result in our taking all or any of the following actions:-        immediate, temporary or permanent withdrawal of your Membership;        immediate, temporary or permanent removal of any Review already posted on the Website;        issue of a warning to you;        legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;        further legal action against you;        disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

We exclude our liability for all action we may take in response to breaches of these Content Standards.  The actions described above are not limited, and we may take any other action we reasonably deem appropriate

7.4.8       We may revise these Content Standards at any time.   You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you.

7.5         Intellectual Property Rights

7.5.1       We are the owner or the licensee of all intellectual property rights in our Website, and in the material published on it.  Those works are protected by copyright laws and treaties around the world.  All such rights are reserved.

7.5.2       You may print off one copy, and may download extracts, of any page(s) from our Website for your personal reference and you may draw the attention of others within your organisation to material posted on our site.

7.5.3       You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

7.5.4       Our status (and that of any identified contributors) as the authors of material on our Website must always be acknowledged.

7.5.5       You must not use any part of the materials on our Website for commercial purposes without obtaining a licence to do so from us or our licensors.

7.5.6       If you print off, copy or download any part of our Website in breach of these Conditions, your right to use our Website (and where relevant your Membership) will cease immediately and you must, at our option, return or destroy any copies of the material you have made.

7.5.7       By submitting any text, image or other information ("Material") to our Website (including, without limitation, by submitting a Review), you agree to grant us a non-exclusive licence to use that Material. Although you still own the copyright in the material, we will have the right (subject to our Privacy Policy) to freely use, edit, alter, reproduce, publish and/or distribute your Material. This licence will be free of charge, perpetual and capable of sub-licence. We may exercise all copyright and publicity rights in the material contained in your material in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.   

7.6         Viruses, Hacking and Other Offences

7.6.1       You must not misuse our Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Website, the server on which our Website is stored or any server, computer or database connected to our Website. You must not attack our Website via a denial-of-service attack or a distributed denial-of service attack.

7.6.2       By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Website will cease immediately.

7.6.3       We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary.

7.7         Links to other Sites

We may also provide links on our Website to the websites or resources of other companies or people, whether affiliated with us or not.  However these links are provided for your information only and you accept that:- 

7.7.1       we have no control over the contents of these sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them; and

7.7.2       we cannot give any undertaking that products or services you purchase from third party sellers to whose site we have provided a link on our Website will be of satisfactory quality and any such warranties are DISCLAIMED by us absolutely.  This DISCLAIMER does not affect your statutory rights against the third party seller.

7.8         Trade Marks

"DINE FOR FUN" is a trade mark of Dine for Fun.

7.9         Concerns

8        Members’ obligations

8.1         If you wish to take part in Dine for Fun you must:

8.1.1          provide us with all such information as we may require and ensure that it is accurate in all material respects (it is your responsibility to provide all applicable information in relation to dietary requirements, allergies or existing medical conditions);

8.1.2          make every effort to attend all dinner parties for which dates have been arranged with other members of your Dine for Fun Group (and confirmed via a confirmatory email from us), making all your own travel arrangements;

8.1.3          host a Dinner Party for the other Members of your Dine for Fun Group, providing the food, drink and entertainment of your choice, and shall be responsible for meeting all costs of the Dinner Party you host;

8.1.4          either host your dinner party on the date set by us, or an alternative date set by agreement with the other Members of your Dine for Fun Group;

8.1.5          contact us or your host immediately if you are unable to attend a Dinner Party;

8.1.6          check the profiles of the other members of your Dine for Fun Group for food allergies and medical conditions, and make provision for such requirements insofar as is necessary and reasonable (and for the avoidance of doubt, where a guest at a Dinner Party which you are hosting has disclosed a food allergy, you MUST either provide food which they are not allergic to, or inform us beforehand that you will be unable to do so and if the member in question still attends your Dinner Party you must ensure that the food to which they are allergic is kept away from them).You should also endeavour to respect dietary preferences where requested by another member of your Dine for Fun Group;

8.1.7          following each Dinner Party that you attend as a guest, post a rating of the Dinner Party on the relevant section of the Website, but you must not share or disclose your rating (all ratings are to be kept secret until the winner of the group is announced);

8.1.8          ensure that any comments you make (if any) in any Review which you submit conform to the Content Standards detailed in Condition 7.4;

8.1.9          ensure that all information provided to you on the other Members of your Dine for Fun Group remains confidential and you shall not share, copy or disclose such information in any way whatsoever;

8.1.10         behave in a polite and proper manner towards the other members of your Dine for Fun Group at all times;

8.1.11        respect the property of the host of each Dinner Part and take care not to cause any damage to it; and

8.1.12        otherwise comply with all of your obligations under these Conditions.

8.2         We reserve the right to withdraw your Membership of Dine for Fun if you are in breach of any of the Conditions set out in Condition 8.1 above.  If your Membership is withdrawn you will no longer be allowed to take part in Dine for Fun.

9        Your Profile

9.1         The Website allows you to upload information to your personal profile ("Profile") in addition to the information listed at Condition 3.5. We shall require you to provide your telephone number to allow us to contact you in the event of an emergency, but shall not share your telephone number or email address with any other person.

9.2         When you upload information to your Profile, it will not be able to be seen by other Members of Dine for Fun. The information shall be sent by email, and for the avoidance of doubt it shall not be possible for other Members to access your profile, which may be accessed only by your ID. .When, following your request to join a Dine for Fun Group, we confirm that we have allocated you to a group, we shall send you the Profiles for each of the other Members of your new group. You may not share the Profiles with any other person, and we reserve the right to immediately suspend your Membership without further notice if you are found to be in breach if this Condition. If, while taking part in a Dine for Fun Group, you add further details to your Profile, we may send your updated Profile to the other Members of your Dine for Fun Group.

10        Our Obligations to you

10.1       We shall:

10.1.1         use all reasonable skill and care in making the Website available to you and in ensuring its availability during your Membership; and

10.1.2        use reasonable endeavours to proide the Services to you when you have become a member.

11       No warranty

11.1       We make no warranty or representation as to the following:-

11.1.1        the quality and suitability of any food, drink or entertainment offered at a Dinner Party that you attend;

11.1.2        the skill, fitness, health and suitability of any member of a Dine for Fun Group to which you have been allocated;

11.1.3        the accuracy or veracity of any information contained in the Profile of a Dine for Fun Member; and

11.1.4        the amount of any expense you may incur in hosting a Dinner Party.

11.2       Because of the nature of the internet and archived information, errors and omissions do occur and we do not give any other warranties in respect of the Website. We make no warranty that the Website is free from infection by viruses or anything else that has contaminating or destructive properties. We shall not be liable to you for any costs, charges or losses sustained or incurred by you arising directly or indirectly from any prevention or delay in the Services, or errors, omissions, or failures relating to the Website.

12       Limitation of Liability

12.1       All Members attend Dinner Parties and take part in Dine for Fun at their own risk.

12.2       Subject to Condition 12.5 below, we do not accept any liability to you or any other party for costs incurred or losses sustained in taking part in Dine for Fun, of whatsoever nature.

12.3       Our Website may contain information posted by other users and content from other internet sites. We have no control over the contents of these sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

12.4       Our maximum liability to you in respect of any loss or damage, whether direct, indirect or consequential and whether in contract or in delict (subject to Condition 12.5, below) shall be limited to the amount that you have paid for our Services over the immediately preceding 6 months.

12.5       Nothing in these Conditions limits or excludes our liability to you for:

12.5.1        death or personal injury resulting from our negligence; or

12.5.2        any damage or liability incurred by you as a result of our fraud or fraudulent misrepresentation.

13       Privacy Policy

11.1      Your privacy is very important to us, however Dine for Fun can only work where the other members of your Dine for Fun Group can contact you and find your house to attend Dinner Parties!  Therefore, we do pass on your address to the other members of the Dine for Fun Group. We do not pass on your email address or telephone number. The information that you provide about yourself to us will only be used by us in accordance with our Privacy Policy. Please read the Privacy Policy carefully and if you have any questions please email enquiries@dineforfun.com.

14       Cancellation and Termination

14.1       Your Membership shall be deemed to commence on the date we send you Membership Confirmation, and we shall then endeavour to make the Services available to you. The Services shall be deemed to commence when we notify you of your allocation to a Dine for Fun Group.

14.2       You may cancel your Membership and receive a refund of your Party Fee if you do so within seven days of receiving your Membership Confirmation by notifying us by email to enquiries@dineforfun.com, unless you have been allocated to a Dine for Fun Group, in which case, you will not be entitled to a refund.

14.3       You may not cancel your Membership once you have registered and been allocated a Dine for Fun Group except in the following circumstances:-

14.3.1        You are unable to attend or host any of the arranged dates for dinner parties with your Dine for Fun Group, and are unable to make alternative arrangements with the other members of your group;

14.3.2        You advise us of the exceptional reasons which mean that you are no longer able to continue to take part in Dine for Fun.

14.4       It shall be at our entire discretion to accept or reject your application or to cancel your Membership under Condition 14.3.

14.5       You have no right to a refund of your Party Fee unless you cancel the contract in accordance with Condition 14.2 above.

14.6       We may suspend or cancel your Membership and/or your access to the Website immediately at our reasonable discretion or if you breach any of your obligations under these Conditions.

14.7       In the event that we cancel your Membership, we are under no obligation to refund your Party Fee, but may do so at your reasonable request.

14.8       The suspension or cancellation of your Membership and your right to use the Website shall not affect either party’s statutory rights or liabilities.

15       Waiver

15.1       If we fail, at any time, to insist upon strict performance of any of your obligations under the contract or any of these Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

15.2       A waiver by us of any default shall not constitute a waiver of any subsequent default.

15.3       No waiver by us of any of these Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing as such.

16       Severability

If any of these Conditions or any provisions of a contract between you and us are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

17       Entire Agreement

17.1       These Conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any contract between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

17.2       We each acknowledge that, in entering into a contract under these Conditions, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such contract except as expressly stated in these Conditions.

17.3       Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any such contract (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these Conditions.

18       Amendments

18.1       We may update these Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the website. Any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the website or otherwise at our discretion. The changes will apply to the use of the Website after we have given notice. If you do not wish to accept the new Conditions, you should not continue to use the Website and must notify your withdrawal from your Dine for Fun Group. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Conditions. 

19       Applicable Law

19.1       These Conditions will be subject to the laws of Scotland. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in Scotland.
